Landlord Terms and Acknowledgment

1. Nature of the compatibility data

The Platform generates an assessment-based compatibility profile for tenants and applicants using an intelligence framework. This profile is:

• not a background check, credit check or criminal record check;
• not a validated predictor of an applicant's payment reliability, likelihood of property damage, lease compliance or any other tenancy outcome;
• not clinically or psychologically diagnostic;
• not a substitute for standard tenant screening such as income verification, employment verification, references, credit history and rental history.

You accept that this data is supplementary context only, meant to support communication and compatibility insight, and not a determining or primary screening tool.

2. Prohibited uses

You agree that you will not, under any circumstances:

• use any compatibility score, profile, behaviour summary or other data generated by the Platform as the sole or primary basis for accepting, rejecting or otherwise making an adverse decision about any applicant;
• use the Platform, or any data it generates, to screen, filter, rank, exclude or otherwise disadvantage any applicant because of disability or mental health status, age, family or marital status or pregnancy, culture, ethnicity or national origin, religion, sex or sexual orientation, employment status, financial hardship or economic circumstance, or any other characteristic protected by applicable Nigerian law or the law of any place where you operate;
• treat any behaviour, profile label or derived score as a proxy or stand-in for any characteristic listed above, whether intentionally or because of a link you assume or infer;
• use any sort, filter or ranking feature made available to you in a way that has the purpose or effect of excluding applicants on those grounds;
• share, publish or disclose an applicant's compatibility profile or underlying data to any third party without the applicant's separate consent, or use it for anything beyond evaluating that applicant's specific application;
• try to re-identify, reverse-engineer or infer an applicant's protected characteristics, including mental health status, from their behaviour data.

Breaking this section is a material breach of these Landlord Terms. It may lead to immediate suspension or termination of your account, in addition to any liability you may have under anti-discrimination, housing or data protection law.

3. Your responsibility for leasing decisions

• You, and not Hyeve Ltd, are solely responsible for any leasing, tenancy or housing decision you make, including complying with all applicable fair housing, anti-discrimination, tenancy and data protection laws where you operate.
• We do not review, approve or endorse any leasing decision made using the Platform. We provide the compatibility data "as is" for information only, as our Terms of Service describe.
• You agree to keep relying on standard, lawful screening practices, such as verified income, references and credit history, as your primary basis for tenancy decisions, and to use Platform data only as supplementary context.

4. Data handling obligations

• You agree to handle any applicant data you receive through the Platform, including compatibility profiles, in line with the Nigeria Data Protection Act, 2023 and any other applicable data protection law.
• You will not store, copy, export or keep applicant compatibility data for longer than needed to evaluate the specific application, and will delete it when the applicant or Hyeve Ltd asks you to.
• You will not use applicant data collected through the Platform for anything other than evaluating that applicant's housing application, such as marketing, resale or sharing with unrelated third parties.

5. Acknowledgment and indemnification

By using landlord-facing features of the Platform, you confirm:

"I understand that the compatibility data provided is supplementary and not validated as a predictor of tenant behaviour. I will not use this data, in whole or in part, to discriminate against any applicant because of disability, mental health, age, family status, culture, ethnicity, religion, sex, employment status, financial hardship or any other protected characteristic. I will not use this data as the sole or primary basis for any housing decision. I understand that I am solely responsible for making sure my leasing decisions comply with applicable law."

You agree to indemnify and hold harmless Hyeve Ltd, its officers, employees and affiliates from any claims, damages, losses, fines or legal costs arising from your use of Platform data in a way that breaks these Landlord Terms, including any claim by an applicant alleging discrimination or unlawful use of their data.

6. Monitoring and enforcement

We may, but are not required to, monitor landlord use of the Platform for patterns that suggest discriminatory filtering or misuse, for example systematic rejection linked to particular results. We may suspend or end landlord accounts, without notice, where we reasonably believe these Landlord Terms have been broken, and may report conduct to the relevant authorities where required or appropriate.

7. No legal advice

Nothing in these Landlord Terms, or elsewhere on the Platform, is legal advice about your duties under fair housing, anti-discrimination or data protection law. You are responsible for getting independent legal advice about your leasing practices.

8. Relationship to other terms

These Landlord Terms are part of, and do not replace, our Terms of Service and Privacy Policy. Where these Landlord Terms are silent, the Terms of Service apply.

9. Changes to these terms

We may update these Landlord Terms from time to time. We will tell you about material changes by email or by updating the "Last updated" date above, and continued use of landlord-facing features after the changes take effect means you accept them.
